Promoter – NXT WIN Collectables

Entrant – Any person/ or persons who enter a competition to win a prize.

Prize – The promoters (NXT WIN Collectables) will operate more than one competition at a time, and each competition will have a specific prize offered.

Winner – The Entrant chosen at random before or after the closing date who will receive the Prize following these Terms and Conditions

General
1.1 By participating in the competition or giveaway, each Entrant unconditionally accepts and agrees to comply with and abide by these Terms and Conditions and the decisions of the Promoter, which shall be final and binding in all respects. The Promoter is responsible for the collection, submission or processing of Entries and the overall administration of the Competition / Giveaway. Entrants should look solely to the Promoter with any questions, comments or problems related to the Competition / Giveaway.

1.2 Upon entering the Competition / Giveaway, all Entrants must submit all contact details as requested by the Promoter (which must include and not limited to Name, valid e-mail and phone number) which will be used for the following purposes:

(a) to notify the Winner that they have won the prize;
(b) to post the Winner’s name on the Website;
(c) to comply with the Privacy Policy.

1.3 All entrants are completely and solely responsible for providing and maintaining the Promoter with correct and accurate contact details.

1.4 The Promoter will be in no way liable for any failure or inability to make contact with the Entrant/Winner due to any errors or inaccuracies in the contact details provided by the Entrant/Winner.

1.5 This promotion is in no way sponsored, endorsed, administered by, or associated with Facebook or Instagram.

Privacy Policy
2.1 The Entrants and the Promoter recognise that the Promoter may use contact details and other data including personal data as defined by the Data Protection Act 1998 supplied by the Entrants to the Promoter to administer the Website and conduct the Competition according to these Terms and Conditions.

2.2 The Entrants and the Promoter also recognise that the Promoter may (either by choice or at the request of a third party) also disclose this information to relevant third parties for the purposes of the prevention of fraud, money laundering (as set out below), legal or other financial or regulatory reasons.

Prize Draw Competitions (Paid/Postal Entries) – ADDENDUM 12/04/24
3.1 The Competition is operated by the Promoter.

3.2 The competitions are open for free entry to residents of the United Kingdom aged 18 years or over except the promoter, their family and their employees. To be eligible for the competition, entrants must be responsible for informing themselves about the laws in their region. The promoter will not be held responsible in any way for entrants that enter the competition unlawfully.

3.4 All Entrants must be registered on the website to be able to participate in any competition, answer the question and purchase their tickets. All entrants are asked to create an account on www.nxtwincollectables.co.uk

3.5 The answers given to the competition questions must be correct in order to enter and compete for the prize. Incorrect answers will be invalid and therefore, not entered into the prize draw.

3.6. i The Entrants and the Promoter recognise that the Competition, its administration and all associated activities are governed by English Law and the Promoter and Entrants recognise that              the County or High Courts of England shall have exclusive jurisdiction in the event of any dispute arising out of the Competition or its administration;

ii.The Promoter reserves the right to refuse or disqualify any entrant if it has reasonable grounds to believe that an Entrant has contravened any of these terms and conditions or acted in a                way that is reasonably considered by the Promoter to be illegal.

3.7 By entering into the Competition, all Entrants acknowledge that their payment for each entry to answer the question and thereby enter the Competition does not guarantee in any way that they will win the prize.

3.8 Competition period can vary but it shall always be stated on the promoter’s website and Facebook every time a new competition is announced. The competition can either last until the entries are sold out, or it can have a set time frame, such as four weeks. Entrants must inform themselves by reading the information provided. When the maximum number of entries of a competition is sold out, the competition will always close. The promoter will not extend any close dates for any competition.

3.9 i. Competition titles featuring phrases such as ‘win every time,’ ‘win with every ticket,’ ‘every ticket wins,’ or any variation thereof, do not permit participation through free entry methods.

ii. These specific competitions, by their very nature, assure the receipt of a prize rather than merely offering a chance to win one. This characteristic removes the element of chance inherent in gambling activities. Consequently, irrespective of the prize’s value, participation guarantees a win for the entrant.

iii. Should the entrant elect to submit a postal entry for any competition falling under the aforementioned category, such entry shall be considered void and ineligible for inclusion in the final draw.

Giveaways (Non-Paid for entries)
4.1 The giveaways are open to residents of the United Kingdom aged 18 years or over except employees of NXT WIN Collectables and their close relatives and anyone otherwise connected with the organisation or judging of the competition.

4.2 There is no entry fee and no purchase necessary to enter giveaways.

4.3 By entering giveaways with NXT WIN Collectables, an entrant is indicating his/her agreement to be bound by these terms and conditions.

4.5 Giveaways are run as nil-value ‘products’ on our website. There is no limit to the total number of entries for giveaways. Each giveaway will be limited to 1 entry per person.

4.6 The closing date for entry will vary but be clearly displayed on the giveaway webpage. After this date, no further entries to the giveaway will be permitted.

4.7 Entry into a giveaway draw will be acceptance of these terms and conditions.

4.8 The prize will only be awarded at the time of the draw, no alternatives will be offered under any circumstance.

4.9 All Entrants must be registered on the website to be able to participate in any giveaway.

Competition Entry
5.1 Enter the Competition during the period stated separately on each competition online or for free by post.

5.2 All Entrants must be registered on the website to be able to participate in any competition, answer the questions and purchase their tickets or send a valid postal entry. All entrants are asked to create an account on www.nxtwincollectables.co.uk before entering.

5.3 Maximum entries vary depending on each individual competition, each competition will state the maximum amount of entries permitted for any natural or legal person for each competition.

5.4 To conclude an entry into the Competition, an Entrant will be asked to provide their contact details (including postal and e-mail addresses and a telephone number) and card payment details (for entry fee only). Once the Entry is submitted, the Entrant’s card payment will be electronically approved.

5.5 When the Maximum Number of Entries and/or the Closing Date is reached, the Competition will close. There is no extension to the competition if the maximum number of entries is not reached.

5.6 All Entries to the Competition are final and no refunds shall be made at any time or for any reason, except in the case of entries submitted after the Closing Date or if the Promoter cancels the competition.

5.7 The Promoter’s decision is final and no correspondence will be entered into about the result of the Competition following the determination of the Winner as described above.

5.8 Postal Entry Route (UK only) – If you wish to enter any of the competitions for free then you must send an unenclosed picture postcard via First or second-class post stating which competition you are entering, the answer to the specific question that relates to that particular competition along with your personal details as follows: Full Name, Date of birth, Postal Address, Email Address & Contact Number to the following address: NXT Win Collectables, Lambourne, Ashes Road, Braintree, CM77 8DW.

(a)Entrants must have an active account that has been used and/or accessed in the last 60 days on our website at the time the free entries are processed, all the details on postcards must match those on the account to which they are to be added;

(b) All entries must be sent to the following address: NXT WIN Collectables, Lambourne, Ashes Road, Braintree, Essex, CM77 8DW

(c) Any entries received that we are unable to read will be excluded from the competition;

(d) The promoters will not be liable for any loss suffered by an entrant as a result of incomplete entries or failed computer communications or for any loss as a result of use of the website;

(e) Should it come to our attention that one person has entered under multiple names, then the entries will be voided. This applies to all entries;

(f) Only one entry to each competition per postcard is allowed. Bulk entries in one envelope will not be accepted as multiple entries and if a bulk entry is received, it will be counted as one single entry;

(g) the Promoter will not acknowledge receipt of your entry nor confirm if your answer to the Competition Question is correct;

(h) all postal entries must be handwritten to prevent any unlawful behaviour in line with 5.9(e), 5.3(a);

(i) your entry must be received by the Promoter prior to the close of the competition, whether this be the closing date or if/when all entries are allocated, whichever is first. Any entries received 24 hours after the close of a competition will not be entered into the random draw;

(j) all entrants must state agreement to these terms and conditions on the postal entry.

(h) free entry route will not be eligible for instant wins on any competition, any postal entries will be allocated a number over the maximum tickets available for sale. e.g 1500 tickets available with 5 postal entries, increases to 1505 available numbers.

(i) postal entries will have no allocated instant win prizes available & will only count towards the final draw.

Entry Validity and Disqualification Criteria

6.1 Automated or robotic Entries submitted by individuals or organizations will be disqualified. Entry must be made by the Entrant. Any attempt by Entrant to obtain more than the stated number of Entries by using multiple/different email addresses, identities, registrations, logins or any other methods, including, but not limited to, commercial contest/competition subscription notification and/or entering services, will void Entrant’s Entries and that Entrant may be disqualified.

6.2 In answering the Question, the Entrant recognises that they must exercise skill, Knowledge and judgement to give the correct Answer; entering a wrong answer will result in a void entry, which will be discounted from the final draw& no refunds issued.

6.3 An entry will be declared void (without a refund) if the entrant engages in, or appears to engage in, the following:

(a) any form of fraud, including but not limited to; fraudulent misrepresentation; fraudulent concealment;

(b) hacking or interference with the proper functioning of the website; or

(c) amending, or unauthorized use of, any of the code that constitutes the website.

(d) Engaging in any form of cyberbullying, harassment, or abuse towards other entrants or individuals associated with the competition.

(e) Engaging in any activity that compromises the security or privacy of other entrants, users, or the competition organizers.

6.4 Any entrant determined to be responsible for any of the aforementioned actions relating to fraud, cheating or hacking will be subject to legal action under Section 42 of The Gambling Act 2005.

Closing the competition
7.1 When the Maximum Number of Entries and/or the Closing Date is reached, the Competition will close, whichever is first. There is no extension to the competition if the maximum number of entries is not reached.

7.2 If the Winner cannot be contacted by the Promoter within 5 working days of being notified of their status as the Winner by e-mail, telephone or Facebook via the contact details submitted along with their entry, then the Promoter reserves the right to then select an Alternate winner, who will then have 5 working days to accept the prize following the same routes of contact as the original Winner. The original winner will have no claim to the prize after the Alternate Winner is selected.

7.3 Competition(s) may be extended due to website downtime or other technical issues which are not the fault(s) of the promoter.

Selecting / Contacting a Winner
8.1 The Winner(s) of the competition will be selected in a random draw from among all eligible Entries received throughout the promotion period. The random drawing will be conducted when all tickets for the competition are allocated or when the competition promotion period is reached, whichever is first. Odds of winning will vary depending on the number of eligible Entries received.

8.2 The winning Entrant will be selected at Random using Google Random Number Generator 2 live on Facebook after the closing of the competition. We use a Google Random Number Generator 2 in order to get the most impartial result for all of our contestants. Check out the Google Random Number Generator HERE.

8.3 Full details of the draw date/time will be confirmed once the competition has been concluded via Facebook and or our website. This decision will be made within 72 hours of the close of the competition.

8.4 Entry lists will be displayed on our website at least 1 hour before any draw taking place unless otherwise arranged or stated.

8.5 There will only be one winner per competition unless otherwise stated.

Prize
9.1 The Promoter owns any prize offered from the time the competition is live until the successful delivery of the said prize.

9.2 The prize will only be awarded at the time of the draw, no alternatives will be offered under any circumstance.

9.3 The Promoter does not supply or give any direct warranty or accept any valuation to the Prize in any way shape or form. The Entrant must make up their own decision through their own enquiries and legal advice before entering the competition.

9.4 Manufacturers of internal components may support warranty claims in the event of a failure.

9.5 Serial numbers of Prizes are documented and saved by the Promoter to prevent any unlawful behaviour.

9.5 No Repairs or Returns will be performed by the Promoter for any of the Prizes.

9.6 No Diagnostics will be performed by the Promoter for any of the Prizes.

9.7 Grand Prize will always be honoured, regardless if the maximum number of tickets are sold.

9.8 Instant win spot prizes will remain the property of NXT Win Collectibles if the Draw concludes and the randomly generated numbers corresponding to the spot prize number has not been selected. Any spot prizes not won in the duration of the draw will be carried over into future draws (at the discretion of the promoter) as either future spot prizes or bundled as a grand prize.

9.9 (a) Occasionally some of the prizes offered are that of Pre-orders for future/upcoming releases. In the event a prize is delayed in shipping to the Promoter, the promoter will keep the winner of said prize updated on the dispatch & delivery of the prize.

(b) Occasionally the promoter will purchase prizes directly from a reseller & arrange for delivery to the Entrants approved account address. The entrant agrees to their personal delivery address to be used by the promoter to enable such purchase.

(c) The entrant’s full delivery address & contact details will be submitted to the agent to provide delivery updates where possible. No other personal information will be submitted to the agent in line with standard GDPR, nor will any promotional boxes be ticked on the entrant’s behalf.

Delivery
10.1 Delivery of prizes is completely free of charge. Prizes will be posted free of charge using a reliable, tracked and insured courier company and/or by the promoter if pre-arranged. Some parts might be packaged separately to avoid damage during transport. This will be pre-arranged with the Entrant / Winner.

Miscellaneous
11.1 Save for death or personal injury the Promoter will not be liable for any loss (including economic loss) suffered to or sustained by any person or property as a result of any act or omission of the Promoters, nor will their servants or their agents in developing, planning and Administrating the Competition, distributing the Prize to the Winner or following the distribution of the Prize; The Promoter accepts no liability for errors or omissions contained within the Prize details, description or specification or any other part of the Website. It is the responsibility of each Entrant (and in particular the Winner) to satisfy him/herself as to the accuracy of any such details and/or any content of this website.

11.2 The Promoter will not be liable for any loss suffered by an Entrant as a result of incomplete entries or failed computer communications or for any loss suffered as a result of use of the Website.

11.3 The Promoter does not accept responsibility for entries which they do not receive due to failures in computer systems, other malfunctions, high Internet traffic, hardware failure, software failure, server faults or any other reason.

11.4 These terms and conditions must not be regarded as a contract between the promoter and the entrant.

11.5 The Winner agrees to allow the Promoter to display his or her name on the Website in accordance with the Privacy Policy.

11.6 The Winner also agrees upon acceptance of the prize that they are required to have Photo(s) and or video(s) taken for promotional purposes, both directly after their win and in any future promotional material.

11.7 The Promoter reserves the right to cancel the Competition at any time either before or after tickets have been sold. If the Competition is cancelled, the Promoter will return any Entry Fees paid to each Entrant (either by bank card refund or by cheque and in one combined payment where several entries have been made by a competitor or store credit). Where the Entry Fee is returned, the Promoter shall have no further liability to the Entrant or to any other person.

11.8 All accounts that the Promoter no longer has a purpose or legal obligation for will be automatically purged in accordance with GDPR guidelines. This includes the purge of all/any personal information for inactive accounts for more than 60 days; the promoter will not inform inactive accounts of this action.

11.9 The Promoter reserves the right to amend these terms and conditions. Any changes will be communicated to NXT WIN Collectables’ current entrants/clients. If you wish to withdraw from a competition/giveaway after the amendment, please inform us in writing via email to: support@nxtwincollectables.co.uk stating which clause you wish to withdraw under.

Money Laundering

12.1 Notwithstanding your agreement with us, there may be circumstances where we are required to act instead and in accordance with obligations or directions arising or given under various powers exercisable by the relevant authorities under the Terrorism Act 2000, the Anti-Terrorism, Crime and Security Act 2001, the Proceeds of Crime Act 2002, the Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017 and/or any Act that replaces them.

12.2 Under these circumstances, we are obliged to disclose otherwise confidential information to the National Crime Agency. Where we know or suspect that a prize draw involves money laundering, we may be required to make a money laundering disclosure. If it becomes necessary to make such a disclosure, we may not be able to inform you that a disclosure has been made or the reasons for it. Where the law permits us to do so, we will tell you about any potential money laundering problem and explain what action we may need to take.

12.3 Information about You: You must be over 18 years of age in order to enter our competitions. When you enter into a competition, you will be asked for your personal information on account creation. In addition, for any winners, we will also ask you for Verification of identity using a government-issued ID, your full address (including postcode) and your name. By agreeing to these terms and conditions, you are agreeing to supply information to us that is correct.

12.4 Verification of identity is compulsory for all winners of all prizes regardless of the size of the prize. These rules have been set out to ensure the safe & secure operations and legitimacy of the promoter, and to follow the regulations set out by our banking & payment merchant providers.
